From the testimony in the police report:
I’m a bicyclist.
Per Highway Traffic Act §147, I travelled in the right lane whilst WB on Dupont, ca. 6:00p. I occupy the centre-left of a right lane when I ride on 4+ lane arterials. My bike is equipped w/ double-strobe LED taillight & headlight. I wear a helmet.
Just W of Bathurst, near the Beer Store, a yellow Nissan X-Terra, BJTZ-777, laid on his horn whilst approaching me from the right lane & then taking the left lane, but just barely. No traffic prevented his passing to the left.
As he approached my side, he pulled down his passenger window. He had a male passenger with him. The driver yelled at me to “learn how to ride.” I yelled back “Highway Traffic Act 147, you’re in my lane.” His SUV drifted/edged over the broken white line, trying to nudge me rightward. I put out my gloved hand, defensively making contact with his SUV. I was still in the left area of the right lane.
This prompted him to sharply veer his SUV rightward, trying to either throw me off road or strike me with his SUV.
I put my hand against the side of his SUV again, told him to back away — that he was breaking the law. He screamed if I hit his “car” again, he’d get out to punch my face. He veered rightward even harder, which pushed me to the right edge of the right lane. I again put out my hand to keep from being struck.
At this point, we’d travelled 2–3 blocks.
He veered harder to push me off Dupont entirely, this time onto the sidewalk (via commercial driveway). He screamed to get off the road, that he was “doing you a favour, buddy.” I screamed back, “Leave me alone & get out of my lane!” I promptly rolled off the sidewalk to get back on the road. He screamed, calling me “a psychopath.” I scream, “You’re a sociopath.” He demurred: “You don’t even know what one is.” I replied, “Like Michael Bryant, using a vehicle to try killing me.” He scoffed. He tried running me off the lane *again*. I told him I’ll call the cops. At the Loblaws traffic light, he sped away.
